Terms of Use

BubbleIdeas (the "Service") is a hosted service operated by BubbleIdeas Technologies. Use of the Service is implicit acceptance of the following 'Terms and Conditions' read together with Privacy Policy .

It is hereby incorporated by reference (collectively, the "Terms and Conditions") that usage of BubbleIdeas platform constitutes total acceptance of laid out Terms and Conditions and of any license agreement(s) that affect or are effected by deployment of this Service.

A BubbleIdeas Account Manager

"Creator" or "Account Manager" of the account using the Service, is the owner of the account. Owner represents and warrants that he/she is the authorized licensee of all text, graphics, website hyperlinks, audio/visual, computer software, and other media residing therein, including any combination of the foregoing (collectively called the "Content").

For private accounts BubbleIdeas will not disclose any Content unless required to do so by a court order or other legal action. The account manager is solely responsible for proper usage of a private account for purpose of internal innovation or people engagement devoid of any pornographic, libelous or derogatory content. Owner undertakes to notify BubbleIdeas administration about any unauthorized usage or illegal activity within his/her account and report both BubbleIdeas and own users about any breach of security, theft of "account manager" password or of any other critical control which may or may not jeopardize privacy of the individual users of the account.

Responsibility of Participants/Service Visitors

For purposes of these Terms and Conditions, to "create an account" or "maintain an account" means to establish an account with BubbleIdeas, regardless of whether you store any Content therein or utilize the Service for any Project/Company. If you create an account using the Service, you are responsible for the Content of that account and any harm resulting from that Content. By making Content available through the Service, you represent and warrant that:

Any visitor utilizing the Service is responsible for taking all necessary precautions to protect oneself and ones' computer system from viruses, worms, trojan horses, and other harmful or destructive Content. BubbleIdeas has not reviewed, and cannot review all of the Content posted to the Service, and therefore cannot be responsible for the Content, its use or effects. By operating the Service, BubbleIdeas does not represent or imply that it endorses the posted Content, or that it believes such Content to be accurate, useful or non-harmful.

Payment & Refund Policy

All BubbleIdeas accounts are available for use & access only if payments are current. A valid credit card is required for paying accounts.

For large-scale enterprise 'licensed' installations, the billing process will be different & separately handled for such purposes.

Cancellation and Termination

You are solely responsible for proper cancellation of your account. You can cancel your account at any time by clicking on the "Account Dashboard" link provided in the manager account. All of your content will be immediately & automaticaly deleted & purged from the system upon cancellation. This information can not be recovered once your account is cancelled.

An email or phone request to cancel your account is not considered cancellation.

If you cancel the Service before the end of your current paid up month, your cancellation will take effect immediately. No refunds for the subject partial month shall be entertained however. The final invoice will contain all charges upto the termination month. You are solely responsible to download, copy or otherwise preserve your Content before terminating your Service account. BubbleIdeas, at its sole discretion, may suspend or terminate an account and refuse any and all current or future use of the Service, for any reason at any time. Such termination of the Service will result in the deactivation or deletion of your Account or your access to your Account, and the forfeiture and relinquishment of all Content in your Account. BubbleIdeas reserves the right to refuse service to anyone for any reason at any time.

Trademarks

'BubbleIdeas', the BubbleIdeas logo, and all other trademarks, service marks, graphics and logos used in connection with the Service are trademarks or registered trademarks of BubbleIdeas or it's licensors. Other trademarks, service marks, graphics and logos used in connection with the Service may be the trademarks of third parties. Your use of the Service grants you no right or license to reproduce or otherwise use any BubbleIdeas or third-party trademarks.

Removal of Content

At its sole discretion, BubbleIdeas may (but is not required to) remove Content from any account utilizing the Service that BubbleIdeas deems potentially:

In the event BubbleIdeas is required to remove Content (as set forth in this Section), BubbleIdeas may, at its discretion, terminate or deny access to and use of the Service by the owner of the account within which such Content is located. In such cases of termination, BubbleIdeas will have no obligation to refund any money or amount paid for use of application.

Copyright Infringement

If you believe that Content located on or linked to the Service violates your copyright, you are encouraged to notify the actual account holder of the Service to necessitate removal/ disablement of such infringing content. BubbleIdeas will not entertain or respond to such notices, nor investigate the allegations pertaining to competitive environment of clients.

In the case of a participant who may infringe or repeatedly infringes the copyrights or other intellectual property rights of BubbleIdeas or others, BubbleIdeas may, at its discretion, terminate or deny access to and use of the Service. In the case of such termination, BubbleIdeas will have no obligation to refund any money paid for use of application to any party whatsoever.

Disclaimer on Content Posted on Other Websites

BubbleIdeas has not reviewed, and cannot review, all of the Content made available through the Service, nor the webpages to which the Service links, and that link to the Service. BubbleIdeas does not have any control over the Content or non-Service websites and webpages, and is not responsible for their content or use. By providing links to a non-Service website or webpage, BubbleIdeas does not represent or imply that it endorses such website or webpage.

Each Service user is responsible for taking all necessary precautions to protect themselves and their computer systems and data from viruses, worms, Trojan horses, and other harmful or destructive content. BubbleIdeas disclaims (refer Privacy Policy ) any responsibility for any harm resulting from use of non-Service websites and webpages.

Limitation of Warranties

Except as otherwise expressly stated herein, all Content posted to or available from the Service is provided "as is", and BubbleIdeas and its owners, suppliers and licensors make no representations or warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title or non-infringement of proprietary rights. You understand and agree that you download from, or otherwise obtain Content and services through, the Service at your own discretion and at your own risk, and that BubbleIdeas and its owners, suppliers and licensors will have no liability or responsibility whatsoever for any damage (whether to your computer system, data or otherwise) that results from the download or use of such Content or services.

Limitation of Liability

In no event will BubbleIdeas or any of its owners, suppliers or licensors be liable to you or any other party for any direct, indirect, special, consequential or exemplary damages, regardless of the basis or nature of the claim, resulting from any use of the Service, or the contents thereof or of any hyperlinked website, including without limitation any lost profits, business interruption, loss of data or otherwise, even if BubbleIdeas, its suppliers and its licensors were expressly advised of the possibility of such damages.

In no event will the aggregate liability for any and all of your claims against BubbleIdeas and its owners, suppliers and licensors arising out of or in any way related to your use of the Service, or the contents thereof exceed the amounts actually paid by you to BubbleIdeas during the six-month period immediately prior to the date a claim is made. You hereby agree that the limitations and exclusions set forth in this Section represent a reasonable allocation of risk and an essential basis of the agreement between you and BubbleIdeas and its owners, suppliers and licensors.
